1. Scope of application

Users can be companies, agencies (hereinafter referred to as "customers") and influencers (hereinafter referred to as "influencers"). 2. Registration and account

2.2. Each user is obliged to treat his or her access data confidentially and to protect it from access by third parties. The platform is not liable for damages caused by improper handling of the access data.

2.3. The platform reserves the right to refuse registrations without giving reasons or to block or delete user accounts in the event of violations of these GTC.

3. Services of the platform

3.1. The platform provides an online platform that allows customers to find and book influencers for marketing campaigns.

3.2. The platform offers a search and matching function that allows customers to find suitable influencers based on defined criteria.

3.3. The Platform does not guarantee the success of marketing campaigns and is not responsible for the behavior or performance of influencers or customers.

4. Obligations of users

4.1. Customers agree to provide accurate and complete information about their campaigns and expectations.

4.2. Influencers undertake to provide truthful information about their reach, target group and influencing strategy and to provide the agreed services on time and professionally.

4.3. Both parties are obliged to respect the contractual agreements and to comply with all necessary legal requirements, in particular in the area of data protection and advertising marking.

5. Conclusion and payment

5.1. A contract between the customer and influencer is concluded by accepting an offer on the platform. The platform itself does not become a contractual partner.

5.2. Payment is made via the payment services offered by the platform. The platform can charge a fee for payment processing.

5.3. The customer is obliged to pay the influencer according to the service provided in accordance with the agreed conditions. The platform may charge reminder fees in case of late payment.

6. Cancellation and cancellation

6.1. Customers and influencers can terminate contracts in compliance with the agreed cancellation conditions.

6.2. The platform reserves the right to terminate user accounts at any time and without notice, in particular in the event of violations of these Terms and Conditions.

7. Liability

7.1. The platform is not liable for damages resulting from the use of the platform, unless these are due to intentional or grossly negligent behaviour of the platform.

7.2. The platform assumes no liability for the content and services of the influencers or for the marketing campaigns of the customers.

7.3. The liability of the platform for indirect damage, consequential damages and lost profits is excluded.

8. Data protection

8.1. The platform collects, processes and uses personal data of users in accordance with the provisions of the privacy policy and the applicable data protection laws.

8.2. Users are obliged to observe the data protection specifications of the platform and not to process any personal data of third parties without their consent.

9. Copyright

9.1. All content and data on the platform are protected by copyright. Any use without the express consent of the Platform is prohibited.

9.2. Influencers and customers grant the platform the right to use and present their content within the platform.

10. Changes to the GTC

10.1. The Platform reserves the right to change these GTC at any time. Users will be informed of changes in good time.

10.2. If a user does not object to the changes within 14 days of notification, the amended GTC are considered accepted.

11. Closing requirements

11.1. Should individual provisions of these General Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
